TERMS OF SERVICE
By commissioning me, you are agreeing to the following terms. Please read carefully before placing an order.

General

✧ Commissions are for Personal Use only unless commercial rights are purchased. (Additional fees apply depending on service)✧ Commissioned artwork may be used for personal display such as profile pictures, banners, etc. and posting on social medias with credit, or printing for yourself, but may not be used for profit without prior agreement.✧ AI/NFT use is strictly prohibited. My work may not be used in AI datasets, engines, or minted as NFTs.✧ I reserve the right to decline commissions outside my abilities or for subjects I will not draw.✧ Communication is important. Estimated commission deadline may be extended to a longer wait time if I do not receive responses to WIPs within a week.✧ You will receive a thumbnail WIP (except in case of a YCH), a sketch WIP, a flat color WIP, and the final shaded WIP. Additional WIPs will be revisions.

Revisions

✧ Any revision related to an error on my end will always be free.✧ During the thumbnail stage for commissions (not YCHs), which is a very loose stick-figure sketch for your idea. You can ask for up to 3 free new versions (major changes, new poses entirely, minor changes, etc all allowed) before a fee of $10 will start being applied for each new version.✧ During the sketch stage, you can request up to 2 free revisions. The main pose idea approved during thumbnail stage cannot be changed, but can have major adjustments. Minor changes can be grouped together as one revision, but they must be asked for all at once in that case. If you request minor changes one at a time, these may count as single revisions due to the added time. All pose/expression revisions must be done in this stage. Each additional revision will have a fee of $15.✧ During the flat color stage, you may only request revisions related to errors I have made on character design, free of charge. If it's NOT due to an error of mine (EX: something you forgot to communicate, or was not on the reference sheet) there will be a fee of $15.✧ During the final shaded stage, you may still request revisions related to errors I have made on character design, free of charge. If it's not due to an error of mine, there will be a fee of $15. You can request up to 1 free revision on shading and lighting color choices, and each additional revision on shading/lighting colors will have a fee of $10.

Designs

✧ You may make any changes, major or small, to adoptables/custom designs.✧ You may not resell the design for more than you bought it for, unless you got it additional artwork.✧ Adoptables and custom designs come with commercial rights in regards to the design itself. The original artwork done by me of the design does not come with merchandising rights, there will be a $50 fee to use my artwork for merchandising purposes.

Payment & Fees

✧ Payments will be in USD through PayPal invoices, or Ko-Fi commission listings if requested.✧ All payments are upfront in full. I occasionally make exceptions for regular clients, so feel free to ask about payment plans.✧ If I do not receive payment within 2 weeks, then your commission will be declined.✧ Complexity fees may be applied anywhere from $10-$50 for all Commissions.✧ If a Commissioner wishes to buy Commercial Use, the fee will be $25 USD for streaming purposes and $50 for merchandising purposes.

Refunds

✧ Full refunds are only available at the thumbnail stage. Partial refunds may be available during the sketch stage. No refunds are available once the flat color WIP is sent.✧ I may cancel and refund a commission at any time for my own reasons.✧ Chargebacks are strictly prohibited. If you file a chargeback, then you forfeit your rights to use the artwork, and you will be blacklisted. I may resell or reuse the artwork as I see fit.

Deadlines & Delivery

✧ You should expect to receive a first WIP within 3 months after accepting the commission. After the first WIP, clients should expect it to be completed within 1 month after that.✧ You will be updated on any delays.✧ If you wish to skip the Queue and be Priority, there will be a fee. The fee can be anywhere from $10-$50 depending on current queue size and progress. You can request a Rush Fee at any point, but if it is after I started the commission, then it may be declined.

Intellectual Property Rights

I, the artist, retain all rights to the comissioned artwork. You are purchasing usage rights, not ownership of the artwork itself.I may use the artwork to:
✧ Promote myself and my services.
✧ Post on social media and in my portfolio.
✧ Create prints/merchandise (for fanart commissions only).Exceptions:
✧ You may request the commission to be private, in which case I will not post the artwork or use it for promotional purposes, however additional fees may apply depending on commission type.

Commissioner Rights

You may:
✧ Use the artwork for personal purposes only (unless commercial rights are purchased) (the design itself in adoptables/custom designs come with commercial rights).
✧ Print the art for yourself
✧ Post it on social media with credit to me.You may NOT:
✧ Use the artwork commercialy without permission
✧ Claim the artwork as your own.

Final Agreement

By commissioning me, you acknowledge that you have read, understood, and agreed to all of the terms above.
